End User Licence Agreement

This EULA applies to mobile applications published by JAPROX LTD and downloaded from the Apple App Store, Google Play or another app marketplace.

1. Introduction

This End User Licence Agreement (“EULA”) is between you and JAPROX LTD (“Licensor”). It governs your use of our mobile applications (each a “Licensed Application”). By downloading or using a Licensed Application, you agree to this EULA and to our Terms of Service and Privacy Policy, which are incorporated by reference.

Licensed Applications are licensed, not sold, to you.

2. Licence grant

We grant you a non-transferable, non-exclusive, revocable licence to install and use the Licensed Application on devices you own or control, as permitted by the usage rules of the app store from which you obtained it. For the Apple App Store, the Licensed Application may be accessed by other accounts associated with you via Family Sharing or volume purchasing where available.

3. Restrictions

You may not rent, lease, lend, sell, redistribute or sublicense the Licensed Application; copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify or create derivative works of it (except as and only to the extent permitted by applicable law); or use it in breach of our Terms of Service or any applicable law, including export control laws.

4. Updates and support

We may provide updates that fix bugs, add features or address security issues. Some updates may be required to continue using the Licensed Application. Support is provided by JAPROX LTD at app@japrox.store.

5. Data and privacy

We collect and use data as described in our Privacy Policy, which you should read alongside this EULA.

6. Additional terms for Apple App Store downloads

If you downloaded the Licensed Application from the Apple App Store, the following also applies:

  1. Acknowledgement. This EULA is between you and JAPROX LTD only, not Apple Inc. (“Apple”). JAPROX LTD, not Apple, is solely responsible for the Licensed Application and its content.
  2. Scope of licence. The licence is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  3. Maintenance and support. JAPROX LTD is solely responsible for maintenance and support. Apple has no obligation to provide any maintenance or support services.
  4. Warranty. JAPROX LTD is solely responsible for any product warranties not effectively disclaimed. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Licensed Application.
  5. Product claims. JAPROX LTD, not Apple, is responsible for addressing any claims relating to the Licensed Application or your use of it, including product liability claims, claims that it fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar legislation.
  6. Intellectual property rights. In the event of any third-party claim that the Licensed Application or your use of it infringes that third party's intellectual property rights, JAPROX LTD, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  8. Developer contact. Questions, complaints or claims should be directed to JAPROX LTD at app@japrox.store.
  9. Third-party terms. You must comply with applicable third-party terms of agreement when using the Licensed Application (for example, your wireless data service agreement).
  10. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

7. Additional terms for Google Play downloads

If you downloaded the Licensed Application from Google Play, you also agree to the Google Play Terms of Service. This EULA is between you and JAPROX LTD; Google is not responsible for the Licensed Application. Purchases and refunds are subject to Google Play's policies.

8. Termination

This EULA is effective until terminated. Your rights end automatically if you fail to comply with it. On termination you must stop using and delete the Licensed Application. You may terminate at any time by deleting the Licensed Application.
